Bring back the death penalty.

Should we bring back the death penalty? To be fair the only answer is maybe.

If we have a cold and calculated killer who has given a confession and there is irrefutable evidenced then the answer should be yes.

However what is irrefutable? We need DNA that places them at the crime and it confirms a time line with blood or semen that must prove more than they where there, it must prove that there is absolutely no doubt the crime was committed by this person.

Circumstantial evidence is not enough.

Semen proves intercourse it does not prove murder. A few splatters of blood may prove a violent act, more blood than it is capable to live on their clothes is irrefutable evidence of committing murder in that time span.

However what are we dealing with, is it a sane murder or that of an addict or mentally challenged individual. It must be that of a deranged killer not a mentally ill or unstable addict unaware of their actions.

Some people need long term if not a life time of medical care not incarceration or death.

You may well end up in a place where your medical condition has no cure in which case life means life. However in areas such as terrorism where people are murdered by exploding a bomb without regard for the target then the rational, clinically sane murder should experience the ultimate justice.

In cases where individuals have killed under extreme circumstance that have threatened their lives it may well be that it must be judged was their actions such that any fair minded individual may have acted in a similar manor?

If someone visits my home with a life threatening weapon or tries to invade the privacy of my car or office or in the street with a weapon intend on significant harm that may be life threatening then in these circumstance a sentence is fair if restraint moves from unconsciousness to death, however in these circumstances capital punishment is unjustified particularly if the death was an unexpected outcome.

It all boils down to intent and premeditation based on a rational hate filed mind, accidental death or a state of not knowing by mental defect or addiction is not sufficient cases for capital punishment.

A rape should be a minimum of 10 years if there is clear proof of a non consensual act, 20 years if it is with a minor, 20 if it is death if we are talking under the influence of no substances or substance that the person has no addiction to.

However causing a death twice should be an automatic capital punishment if intent and premeditation is proven assuming no mental defect is present.

I am not pro capital punishment however under certain circumstances it is just as we have no better solution. However it is vitally important that capital punishment is only used when proof is absolute when referring to a sane mine with intent and premeditation.

Much as murderous addicts and mentally deficient individuals may murder this in it’s self is not sufficient grounds for capital punishment.

An individual must have the right to defend themselves and under these circumstances capital punishment is not acceptable. However if an individual was to murder my family or friends and I took it in to my hands to my hands to kill that individual with intent and premeditation then even with intent and premeditation the term should be life until they pass instead of capital punishment.

Capital punishment should be used as a last resort and very, very sparingly, political and social pressure must have absolutely no bearing on the outcome.

Judge it on the bases under the circumstances what would you do, and is this sufficient grounds for latitude? If there is absolutely any case for latitude then capital punishment is not an option.

In the 21st century we should not use capital punishment however at times it is the only fair and reasonable solution however it should be by injection inflicted by a random method so no one can say they took a life unjustly.

Hopefully as we move forward to the 22nd century we can find a way of creating a much better solution that is more pro active than reactive. We all create an environment of violence by our inaction to change the environment that makes this possible.

Northern Rock has hit rock bottom.

In the interested of tax payer, shares in Northern Rock have been suspended and plans are in place to propose nationalization.

However there is a major stumbling block will the Conservatives lend their support to nationalization.

Why should they, resistance or even a delay will no doubt harm Labour and may well result in the chancellor stepping down. Nothing like giving the opposition ammunition and there is very little chance they will lend their support just because the country needs them to.

Labour have effectively walked away from proposals from within the bank and from Richard Branson consortium therefore Labour has effectively burnt its bridges and given themselves very few options, none of which are ideal.

Should we bail out banks that are stupid enough to lend to those that can’t afford to pay their debts?

The only real option is to take on no more debt, factor off whatever debt they have and give back investors there money which no doubt the Government will have to borrow from another bank to pay for!

At that point five things happen.

The tax payer will gets shafted again as expected.

Banks will realize they actually have to lend responsibly.

Many people will lose their homes and end up renting to landlords that bought property for way below market value.

Property prices will crash and people in rented accommodation will be able to pay back some of their personal debt, thereby helping the economy as savings and buying increase with real money.

As people become more solvent, property prices will start climbing again so we can enjoy this madness for another cycle.

Is America in recession or bankrupt?

America is in turmoil, we know that the mortgage crisis is still spiralling as banks have to make some sort of loss disclosure for their annual accounts. No matter how they manipulate the figures it just does not look good for the USA economy.

Government debts are at an all time high.

Having just had my computer hijacked by Security Toolbar 7.1 which is screwing up my computer and recommending I buy some extortion ware more commonly known as rogue anti spyware.

For your information this Security Toolbar 7.1 pretends to be a video code update then it screws with your computer so it is safe to say do not buy any of the following products.

To be fair it was my own fault I am off my lap top as I have exceeded my USB 3 GB download therefore back on to my old desk top that is rather antiquated with considerably less protection than my lap top.

I have personally used Spy Sweeper, Spy Doctor and Nod 32, all are good and all have particularly good reviews. What I will say is nothing will catch everything so it is a good idea to have a few solutions and run each one, one at a time if your having problems.

As a quick fix you may be able to do a window restore to the previous day, if this is an option, back up your important files and try this. This worked for me and cost me nothing. It should work in Vista and XP, not sure about Macs.

If you come across any other spyware products that manufacturers should be in jail for them please comment.

New continent found, stake your claim

It is true a new continent has been discovered between Hawaii and Japan that is actually twice the size of the USA.

Now you are probably wondering why has no one noticed it, surely with all our spy satellites some one must know it is there?

Well the truth is big brother wishes to keep it quite as this new continent is rubbish. Yes it is true it has very little oil, virtually no valuable minerals and of limited use, so no country is ready to spill blood for it.

So your probably wondering just how bad this continent really is if know one actually wants it or for that matter even wishes to mention it. The fact is it is rubbish but when I say rubbish I really mean real rubbish, like plastic bags, fast food boxes and all those little crappy plastic things we all throw away that never actually disappear.

It is almost like a Bermuda triangle for crap no one wants. However relax, there may be a day when you can stake your claim as this continent is growing daily as over a million sea birds a year and 100,000 mammals each year die because of the plastic we dump in the sea.

Once we have a sufficiently high pile of birds and animals then we can claim this continent for Scotland and wait a few million years for their rotten corpses to turn to oil.

Man dies of thirst at McDonald's

Well this is almost true.

It irks me that I get a half sized portion at McDonald's for twice the price I used to pay in the USA.

However what really pisses me off when I can't even get a cup of water particularly as water is free in McDonalds in the USA.

So now I have slightly better service as the foreign staff mainly speak English, or at least the managers do. However I only wanted a cup of water as the tea was so hot I could not taste it.

Muttering in the corner listening to their tradesman hammering I wondered if I would have to pay to use the toilet or whether I would be shafted in a different way.

No fee, I was in heaven until I seen the blocked loo. It is always nice to see crap floating in a pan just after you have eaten. However a man has to do what a man has to do. So being educated in the finer points of health I decided to wash my hands. Problem was the sink was no more than 10 inches wide and would have been perfect for a child on a large stool.

So I persevered and washed my hands the best I could with the skin stripping boiling water and missing soap. Thank god we have hand dryer, which actually cause more germs. But I was safe the germs were not in with a shout as the drier was broken.

I must admit I did feel bad wiping my wet germ filled hands on the door handle the tradesman had just fixed.

So I apologise to the McDonalds of Gylemuir Road, Corstorphine, Edinburgh, I will not be back, I shall drive the 50 miles home and drink water from my own tap, for no other reason that you are the filthiest McDonalds if have ever had the misfortune to endure.

Minister for Europe wastes £3 million..

Minister for Europe, External Affairs and Culture - Linda Fabiani MSP has successfully given £3 million of Scotland’s people’s money to Malawi. Interestingly Malawi’s largest city is called Blantyre so I can only assume this was where the mix up happened.

The Republic of Malawi formerly known as Nyasaland is a democratic, densely populated country located in South Eastern Africa, which I guess must now be in Europe!

Some of the more significant problems facing Malawians include:

1. Insufficient nutrition
2. Poor access to medical treatment
3. Extreme lack of foresight by Government
4. Mis-use of international donations
5. Insufficient school education
6. Spread of HIV/AIDS
7. Government economic restrictions
8. Corruption
9. Climate change

I think I understand the plan, if Linda Fabiani MSP can solve the problems of Malawi, them maybe we can role out the solution to Scotland who also share many of the Malawi social issues.

Having successful marketed Glasgow as the murder capital of Europe and the place to be to get in a cool gang, I just wondered if that money that must have been meant for Blantyre could be used to top up our £200K war chest to tackle gangs.

Great job Linda, nice to see you have found a jolly in the sun while Scotland goes to ruin around about you.

Call me close minded, fix Scotland first and if we have any money left feel free to spend it in Blantyre, until then get on with the job you were elected to do.

Shoot all smokers...

Why not. We have taxed them to death. Banned smoking from pubs, clubs, cars and restaurant, surly shooting is the next step.

The 500 carcinogenic compounds in cigarettes are not working fast enough. The next big brother brain wave is to license smokers at £10 a year!

Why not have their faces on posters on every wall, get them to sign a repeat offenders list and tax them with a pollution tax and a tax for luxury waste disposal.

No harsh measure is enough. Tattoo their foreheads and remove all their assets. May be I am wrong but this direction all sound so familiar.

May be the solution is simpler, why not removing stupid corrupt politicians, surely this would be a more effective solution to protecting peoples civil liberties.

Create smoking bars and restaurants and let the business owners pay the license. Then people have a choice to smoke or not to smoke, where they wish to.

When we sit back as big brother destroys our planet it is nice to see we can be so easily manipulated by a simple diversion.

Legal drugs kill more lives than illegal drugs, but there is no panic, it’s ok because the government knows how to tax them.
